DUI Ticket

If you have been arrested for a DUI in Broward, Dade, or Palm Beach County, the police will most likely take away your license the day/night you are arrested. This is very important because most people believe that they cannot drive once this happens. This is not true.

Once you are arrested for a DUI, the police issue you a DUI citation which is your driver’s license for the next 10 days. Most people do not know this and simply do not drive. At the bottom of the citation, it says that this will serve as a temporary driver’s license for the next 10 days unless the person is unauthorized to drive

The hiring of an attorney immediately upon your arrest is essential because your attorney can get you an extended driving permit for the next two months. If you delay, you will lose this right and forfeit the privilege to drive.

Bonding out

Bonding out

If you are ever arrested, you will be given a bond amount depend on the
charges you are facing. For example, a first DUI without an accident
has a list bond of $500.

The jail, for first time offenders, will offer what’s called “pre-trial
release”. This will not require you to post a bond. Most people who
are arrested jump at this option because they think….I don’t need to
post a bond or pay a bondsman.

This is true but pre-trial release can also be a leash around your neck.
Pre-trial release requires you to call in to a pre-trial officer 2-3
times a week and depending on the magistrate judge the morning after you
are arrested. You may also be required to attend AA meetings and or drug
classes.

My advice is to bond out and not use pre-trial release unless absolutely
necessary….you have no money to post a bond. It’s better to be out on
bond and not be required to check in with anyone except your lawyer.

Traffic Tickets

traffic tickets

Many of us receive traffic citations on a monthly or yearly basis. The
important thing to remember is that simply paying the citation is not
the easiest way to handle that annoying problem.

If you simply pay the citation, even a non-moving violation, your
insurance rates can and most likely will increase due to the fact that
you have been adjudicated of that citation. Once you pay the ticket,
you are adjudicated of it because you chose the route of paying the
citation instead of hiring an attorney.

The Police Officer who stops you will often times suggest that you pay
the ticket because hiring an attorney will cost more. This is simply
not the case. Hiring an attorney almost always will ensure that you do
not receive points for that ticket. The attorney can often times be
able to get the ticket dismissed which is the best case scenario.

When three-year-old Caylee Marie was reported missing by her mother, Casey Anthony, all of Orange County, Florida began to search for her. When her body was recovered in a wooded area a few months later, it sent the county into an uproar. The mother was arrested for the murder of her daughter and frantic investigations began. The mother’s attorney is now working to prove that Orange County Police did not react properly when a 911 caller reported seeing something in the woods where she was found. He made three calls over a period of three days, but police never fully investigated. The attorney believes that he can get the police department for negligence, and may be able to free his client.

The mother is also in the process of being sued for defamation of character by her daughter’s babysitter. The mother made claims that the babysitter had abducted her child. However, Anthony’s attorney has filed papers to request that the defamation trial be moved until after the criminal trial. Oftentimes, when a child goes missing, or ends up dead, the parents are the first to be blamed. If you have been incarcerated, on top of the pain of losing your child, contact the Menditto Law Office for experienced criminal defense lawyers today.

Death Penalty Down As Form Of Punishment

In October of 2002, Roy Lee McDuffie entered a Dollar General Store and brutally murdered two employees, to get the $7,000 that was kept in the cash register. The man bound and gagged the two women, slashed their throats several times then finally shot in the head. The sister of one of the victims was hoping that the man would get the death penalty for his crime. In 2005, a Florida jury sentenced him to death by lethal injection, but the Florida Supreme Court said that his trial had been unfair, and ordered a re-trial. During his second trial, McDuffie was sentenced to life in prison, instead of the death penalty.

The man was moved from death row, where he was kept in solitary confinement, to the rest of the prison, he sleeps in a dormitory, works for a job or a program during the day and reports back to his cell, where he has a phone to call his loved ones in the evening. Many people believe that he got this lightened sentence, because the number of death penalty sentences are on the decline. Woman Murdered In Botched Police Sting Operation

When a young Florida woman was facing drug charges and jail time for possession of marijuana, she was offered a choice. She could either go to jail, or participate in an undercover sting operation to help bust some local drug dealers. However, the woman was sent into the operation with no training on how to handle the situation, and was shot and killed by the suspects that she was helping to uncover. The young woman’s father is working to create a law, which would be named after his daughter, Rachel. It would require police to do careful checks and training of their informants, and provide them with access to a lawyer, which he said that his daughter was denied.

Florida police tried to say that the murder was the girl’s own fault, because she chose to be a criminal. However, a petty drug crime hardly seems worthy of death. The police later retracted the statements, but it does not change the fact that this young woman was shot and killed, because of their negligence. If you or someone you love has been hurt during a police sting operation, you deserve quality defense. Call the Menditto Law Office for more information today!

What to do first when you recieve a DUI

Tuesday, April 22, 2008 @ 07:04 PM

There are many things that must be done when you get arrested for a DUI but the first involves your license. As soon you are released from jail due to a Dade DUI, Broward DUI, or Palm Beach DUI, you must contact an attorney. This is so vital because your license is immediately at issue.

If you did not give a breach, urine, or in some cases blood when requested by a police officer, you license is suspended for one year. This suspension can be withdrawn for many reasons but only a trained attorney knows the law and how to protect your rights. Once arrested, the traffic ticket you received for a DUI is your license for ten days. During this time, you must request a formal hearing with the department of motor vehicles. This request has to be done within ten days of your Dade DUI, Broward DUI, or Palm Beach DUI.

If you do not request this hearing within these ten days, you and your attorney cannot challenge your one year suspension. If you are successful challenging your one year suspension, your license will be immediately reinstated.

If you gave a breath same the day of your Dade DUI, Broward DUI, or Palm Beach DUI, and this sample is over the legal limit of .08, then your license is immediately suspended for 6 months. Your DUI ticket is again your license for the next ten days. Again, you and your attorney can challenge your suspension if done so within ten days of your Dade DUI, Broward DUI, or Palm Beach DUI.

Protecting your license is the first and foremost thing that must be done and protecting your rights is the goal of Mr. Menditto.

what is a dui

The best way to avoid a Palm Beach DUI, Broward DUI, or Dade DUI is to know the law. What better way is there to avoid a problem then to know what constitues that problem? Knowing the DUI laws will protect you from falling into the same scenario.

The police, when arresting for a Palm Beach DUI, Broward DUI, or Dade DUI, have to follow the same DUI laws that Congress has enacted. If the police violate your Constitutional rights, then all the charges can be thrown out no matter how damaging your Palm Beach DUI, Broward DUI, or Dade DUI may be.

Know your rights.

Time is of the essence

It you are scheduled for court, being on time is paramount. If the judge calls your case and you are late, the Court can and will issue what is called a “Capias” which will lead to a warrant for your arrest.

If you have posted a Palm Beach Bond, a Broward Bond, or a Dade Bond, the judge will forfeit it costing you so much that was unnecessary if you were on time.

Your Palm Beach Bond, Broward Bond, or Dade Bond is the only security the Court has that you will return to face your criminal charges. If you have questions about the time of your court date, contact us or your Palm Beach Bond agency, Broward Bond Agency, or Dade Bond Agency.

We have a convenient location walking distance from the Broward County Courthouse ready to represent you.

Traffic ticket…why not just pay

Wednesday, March 26, 2008 @ 03:03 PM

The second reason that you shouldn’t pay your Palm Beach traffic ticket, Broward traffic ticket, or Dade traffic ticket again is due to points. If you just pay your traffic ticket, you will be given points which can affect your insurance rates.

Anytime your insurance company sees that you were given points for a West Palm traffic ticket, Broward traffic ticket, or Dade traffic ticket, they most assuradely they will raise your rates. This can mean add up to over $1,000.00 a year in some circumstances when if you simple hired an attorney for a small fee, this could have been avoided.

Even non-moving violations, such as Palm Beach traffic ticket, Broward traffic ticket, or a Dade traffic ticket for window tinting being too dark can and will raise your rates.

Simple put, seek the advice of an attorney to help you.
